1. Legal Jurisdiction
These Terms are governed by the laws of the United States of America and will be interpreted accordingly. Any legal disputes related to these Terms may be brought before courts within the United States.
As a consumer, you retain the benefit of any mandatory legal protections provided under applicable laws. Nothing in these Terms overrides your right to rely on such protections.
2. Member Support
To access the Services, your device must meet the platform’s minimum requirements, including internet access and compatible software. Datarix LLC provides assistance for Member Users, including troubleshooting and periodic updates, Daily 8:00am to 8:00pm, EST. Additional equipment or services may be required, and Datarix LLC is not obligated to offer support beyond what is outlined in these Terms.
3. Payment Terms
Fees for the Service are displayed on the Website and communicated at the time of subscription. The monthly subscription begins immediately upon sign-up for a fee of $39.99 and renews automatically every 30 days unless cancelled. If you do not unsubscribe, the Service will automatically renew on a monthly (30 days) basis and you as the user give permission for a monthly charge/fee of $39.99. In the event of an unsuccessful recurring payment, Datarix LLC reserves the right to apply a discounted membership rate, allowing you continued access to the Service. If this discounted rate cannot be processed successfully, an administrative fee of up to $3.00 may be applied to maintain your subscription until the full or discounted subscription fee is successfully processed.
Datarix LLC is not liable for issues with your payment method; disputes should be directed to your payment provider. All payments must come from legitimate funds and users are responsible for their own browsing or data fees.
4. Refund Policy
Any refunds owed to you will be processed promptly and no later than 14 days after you notify us of your decision to cancel the Service, minus any applicable deductions. Refunds will be issued using the original payment method unless another arrangement is agreed upon. Refund requests must be made within 30 days of sign-up.
These refund provisions do not affect your statutory rights. Once processed, refunds typically take 3-5 business days to appear on your card.
5. User Responsibilities
You agree to use the Services solely for lawful, personal, and non-commercial purposes. You will not:
• Violate the rights of others, including intellectual property or privacy rights.
• Use unauthorized methods to access, distribute, or interfere with the Content or Services.
• Employ automated tools, such as bots or scripts, to access or manipulate the Services.
• Introduce harmful software, disrupt functionality, or gain unauthorized access to the platform.
• Remove or alter any advertising or security features associated with the Services.
• Collect personal data in breach of Datarix LLC’s Privacy Policy.
• Promote or encourage illegal or harmful activities.

6. Terms of the Agreement

Datarix LLC reserves the right to revise or update this Agreement at its sole discretion, without prior notice. Datarix LLC retains the right to decline any application or request for access to the Service, at its sole discretion and without the need to provide a justification.

The quality of the content displayed on your device may differ depending on several factors, including your geographic location, the bandwidth of your internet connection, and its overall speed. Users are entitled to terminate their subscription at any point, beginning from the date of registration. Should cancellation occur after billing has commenced, the subscription will be deactivated immediately, but the account will remain active until the end of the prepaid period.

Datarix LLC reserves the right to modify, suspend, terminate, or discontinue the Service or this Agreement at any time, either temporarily or permanently, in whole or in part, for any reason or no reason, with or without prior notice, and without liability to you. This may include, but is not limited to, actions such as suspending access for failure to pay subscription fees within the required timeframe, inactivity, use of multiple or unauthorized free accounts, non-compliance with the rules set forth in these Terms, or for maintenance and updates to the platform.
For Paid Users, unless you have breached this Agreement, any material changes that negatively affect the Service, or the suspension or termination of the Service, will typically occur at the conclusion of the current billing period. However, Datarix LLC retains the right to immediately terminate or suspend the Service and may issue a prorated refund for any unused portion of the billing cycle. By continuing to use the Service after such changes, you waive any claim for additional refunds.
13. Consequences of Termination
When the Site or Service is terminated, cancelled, or discontinued, your right to access and use the Site or Service will end as specified. You will no longer have access to your account, including any files or content stored within it, although Datarix LLC may retain such content at its discretion.
